Texas AG sues Biden admin over requiring pharmacies to fill Rx for abortion pills
The Texas Attorney General filed a lawsuit this week against the Biden administration, accusing the White House of overstepping when it released guidance last year to pharmacies nationwide instructing them to fill abortion pill prescriptions after the Supreme Court overturned Roe v Wade.
The federal government asked over 60,000 pharmacies in the US to continue fulfilling prescriptions for abortion medications in spite of a June Supreme Court ruling that gave the states authority to govern their own abortion laws. On Tuesday, Texas AG Ken Paxton filed a suit against the Department of Health and Human Services over its July guidance, saying the action is inconsistent with the SCOTUS ruling.
“The Supreme Court’s June 2022 Dobbs decision made clear that laws governing abortion are to be decided by state lawmakers, not the federal government,” Paxton wrote. “HHS’s guidance thus run
s contrary to Dobbs by unlawfully preempting certain states’ laws that bar pharmacies from supplying these abortion-inducing drugs.”
He railed against the administration’s attempt to maintain access to legal abortions, saying, “The Biden Administration knows that it has no legal authority to institute this radical abortion agenda, so now it’s trying to intimidate every pharmacy in America by threatening to withhold federal funds. It’s not going to work.”
