Trump to apply for change of venue, recusal of judge

Former President Donald J. Trump will apply to recuse the judge trying his Washington, D.C. criminal case. He will also ask for a change of venue, presumably to one of two federal districts in West Virginia.

Trump says he cannot get a fair trial in D.C.

Trump posted to Truth Social that he cannot “get a fair trial” before the judge assigned to his case. In that post he said his lawyers would ask for a recusal of Judge Tanya Sue Chutkan form the case. They will also ask for a “change of venue out of D.C.”

CourtListener has opened a docket page on Trump’s January 6 related case here. According to it, Trump remains on personal recognizance. He has pleaded Not Guilty to all four counts of his August 1 indictment.

Judge Chutkan has an adverse history with Trump, which would be the most likely ground to “recuse” the judge. She also has a reputation for handing down the harshest sentences to persons caught up in the January 6 Event.

Recusal would mean that the District Court would assign another judge to his case. But in addition, the Attorney General of West Virginia publicly called yesterday for a change of venue to his State.

West Virginia has two federal districts, the Northern and the Southern.

The protective order

The docket page also shows a motion for a “protective order” against Trump, who “trolled” the government on Truth Social.

Apparently Special Counsel Jack Smith has chosen to interpret the above as a direct threat against himself, his staff, and anyone else who disagrees with Trump. They moved for a “protective order,” and the court has scheduled a hearing on the matter. Trump’s response to the motion is due today at 5:00 p.m. EDT.

Today Trump posted several “truths” in protest of the protective-order motion. (See here, here, and here.)
