No executive order: true!

Last month (November 22), Dr. Orly Taitz released a statement few believed at the time. She said Barack Obama never actually issued or signed any executive order granting amnesty to millions of illegal immigrants. Today we have confirmation of that lapse, from a sitting United States Senator.

He didn’t sign an executive order?

Senator Jeff Sessions (R-Ala.) laid it out today, according to Garth Kant at WND.

I guess they just whispered in the ear of [DHS Director] Jeh Johnson over at Homeland Security, “Just put out a memo. That way we don’t have to enforce the law.”

Senator Sessions must mean this memo. It speaks of using “prosecutorial discretion” not only in handling an illegal immigration case but in whether to open it or not.

Jerome Corsi, also at WND, finally ran with the story last week (December 4). If Corsi saw Orly Taitz’ analysis, he never said. But the National Archives and Records Administration confirmed to Corsi on Thursday that it has no executive order on file on the subject of amnesty, and no executive order of any kind on file for November 20. Obama made a speech then, but signed nothing.

Again: Obama did not put anything in writing. Jeh Johnson, SecHomeSec, did.

So what did Obama sign in Las Vegas on November 21, when he said he was going to sign an executive order? This. A memorandum, or proclamation, about “integrating immigrants and refugees.” A general statement.

Yet the Attorneys General of twenty States, with the Texas AG taking the lead, are suing the administration, and specifically Jeh Johnson and his subordinates, in federal court over what is supposed to be an executive order. The case will go before Judge Andrew S. Hanen of the District Court for the Southern District of Texas. George W. Bush appointed Judge Hanen. Furthermore, Judge Hanen has already rebuked SecHomeSec Jeh Johnson once before.

What will this judge do when he hears Obama never put anything in writing? Remember: the lawsuit names the United States, and Secretary Johnson and several agency heads, as defendants. So if this whole fuss is only about Jeh Johnson’s memo, Obama could throw Jeh Johnson under the bus.

Is that what he wanted? Plausible deniability?
